Suppliers and subcontractors essentially help finance the construction of houses and commercial buildings. They do so initially as unsecured creditors, providing their materials and labor on credit, knowing that they have the option to secure the debt with a lien on the real property improved should they not get paid. If the option to secure the debt with a lien was not legally available, or if lien filing was made too complicated and costly, then these creditors would not be so willing and able to finance the construction industry. As it is, the Georgia lien laws have been effective enough to make Georgia counties top the country in growth year after year for more than a decade. It is imperative that we protect lien rights in Georgia to continue our unprecedented growth, and continue to bring jobs and money to the State. |
